Q: Is zakaat compulsory on goods?

Zakaat on Debts owed to a Person

 

Q: Is it necessary upon a person to discharge the zakaat of those monies (debts) which are owed to him?

A: There are few types of debts:

 

  • Dain-e-Qawi: That debt which is owed to one in exchange of goods sold or monies loaned. The law of this type is that zakaat is waajib upon these debts provided it reaches the nisaab.
  • Dain-e-Mutawassit: Those debts which are owed to a person in exchange of any goods which were not purchased with the intention of resale. E.g. a personal car or furniture when sold for cash. The law of this type is that zakaat is only waajib upon the debt when received provided it reaches the nisaab and one year passes over it. Zakaat is not waajib on the debt for the previous years.
  • Dain-e-Daeef: Those debts which are not in exchange of wealth e.g. mahr or monies owed in lieu of service provided. The law of this type is the same as the one above (Dain-e-Mutawassit) i.e. Zakaat is only waajib upon the debt when received provided it reaches the nisaab and one year passes over it. Zakaat is not waajib on the debt for the previous years.

( و ) اعلم أن الديون عند الإمام ثلاثة قوي ومتوسط وضعيف (فتجب ) زكاتها إذا تم نصابا وحال الحول لكن لا فورا بل ( عند قبض أربعين درهما من الدين ) القوي كقرض ( وبدل مال تجارة ) فكلما قبض أربعين درهما يلزمه درهم ( و ) عند قبض ( مائتين منه لغيرها ) أي من بدل مال لغير تجارة وهو المتوسط كثمن سائمة وعبيد خدمة ونحوهما مما هو مشغول بحوائجه الأصلية كطعام وشراب وأملاك ويعتبر ما مضى من الحول قبل القبض في الأصح ومثله ما لو ورث دينا على رجل ( و ) عند قبض ( مائتين مع حولان الحول بعده ) أي بعد القبض ( من ) دين ضعيف وهو ( بدل غير مال ) كمهر ودية وبدل كتابة وخلع

قوله ( في الأصح ) قد علمت أنه ظاهر الرواية وعبارة الفتح و البحر في صحيح الرواية قلت لكن قال في البدائع إن رواية ابن سماعة أنه لا زكاة فيه حتى يقبض المائتين ويحول الحول من وقت القبض هي الأصح من الروايتين عن أبي حنيفة اهـ ومثله في غاية البيان وعليه فحكمه حكم الدين الضعيف الآتي (شامي 2/305)

Discharging Zakaat of the Past Years

 

Q: What is the Shar’ee ruling regarding a person who did not discharge the zakaat of his jewellery, wealth and stock in trade for many years? How should he discharge the zakaat of the previous years?

A: It is compulsory upon one to discharge the zakaat during the year the zakaat became compulsory. If one delays in discharging the zakaat until the following years zakaat became compulsory, one will be sinful. The law pertaining to zakaat of the missed years is that one will evaluate his zakaatable assets and discharge 2 ½ % of the total for each missed year.

E.g. A persons zakaatable assets are evaluated at R100 000. He will discharge 2 ½ % of R100 000 (R2 500) for the first year. He will be left with R97 500. Thereafter he will discharge 2 ½ % of R97 500 (R2 437,50) for the second year. He will be left with R95 062, 50. He will discharge 2 ½ % of that amount for the third year. In this manner he will discharge the zakaat of the remainder years. This is in the case where one did not spend the wealth.

In the case where the person spent the wealth or sold the stock in trade and he is unable to ascertain the exact amount of wealth he possessed for each year of the ten missed years, he will apply his mind to the best of his ability in trying to work out the amount which he possessed for each year and accordingly pay 2 ½ % of that amount for the respective years.

If he is true and honest in working out his zakaat for the ten missed years and sincerely repents for the sin of delaying the zakaat, then Insha Allah Allah will forgive him.

Q: Which people are not eligible for zakaat?

A: The following people are not eligible for zakaat:

  1. A non-Muslim
  2. A Sayyid (descendent of Nabi Alaihis salaam’s family i.e. the Banu Haashim) even if he is poor. (The Banu Haashim include the descendents of either ‘Abbaas, Ali, Jafar, Aqeel or Haarith Bin Abdil Muttalib (Radiyallahu Anhum))
  3. The donors ascendants e.g. his parents, grandparents, etc. and descendents e.g. children, grandchildren, etc.
  4. The donors spouse (husband or wife)
  5. A minor whose father is wealthy
  6. A wealthy person (A person who possesses that amount of wealth which equals the nisaab after deducting all his liabilities and debts)

(لا) يصرف (إلى بناء) نحو (مسجد و)…. (و) لا إلى (من بينهما ولاد) ولو مملوكا لفقير (أو) بينهما (زوجية) ولو مبانة وقالا تدفع هي لزوجها… (و) لا إلى (غني) يملك قدر نصاب فارغ عن حاجته الأصلية من أي مال كان كمن له نصاب سائمة لا تساوي مائتي درهم…(و) لا إلى (طفله) بخلاف ولده الكبير وأبيه وامرأته الفقراء وطفل الغنية فيجوز لانتفاء المانع (و) لا إلى (بني هاشم) إلا من أبطل النص قرابته وهم بنو لهب فتحل لمن أسلم منهم كما تحل لبني المطلب ثم ظاهر المذهب إطلاق المنع وقول العيني والهاشمي يجوز له دفع زكاته لمثله صوابه لا يجوز نهر… (ولا) تدفع (إلى ذمي) لحديث معاذ (در المختار 2/344-350)

Will Zakaat be Discharged by giving it to such a person who one Incorrectly Regarded as Eligible

 

Q: A person gave zakaat to a muslim whom he regarded to be eligible for zakaat. However, after giving him the zakaat he discovered that he was unworthy of zakaat. Is the zakaat discharged?

( دفع بتحر ) لمن يظنه مصرفا ( فبان أنه عبده أو مكاتبه أو حربي ولو مستأمنا أعادها ) لما مر ( وإن بان غناه أو كونه ذميا أو أنه أبوه أو ابنه أو امرأته أو هاشمي لا ) يعيد لأنه أتى بما في وسعه حتى لو دفع بلا تحر لم يجز إن أخطأ (شامى 2/352)

Will Zakaat be Discharged by Paying a Poor Person’s Light or Water Account?

 

Q: Will zakaat be discharged by paying a poor person’s light or water account?

A: The fundamental requirement in the discharging of zakaat is the aspect of Tamleek i.e. to transfer ownership of the wealth to the recipient of zakaat. Since this requirement is not fulfilled in the case where the person paid the water or light account, the zakaat will not be discharged. However, if one fears that if he gives the money to the poor man then instead of him paying his water or light account he will misuse the wealth then in this situation he may ask the poor man for permission to pay the account on his behalf. In this way the zakaat will be discharged.

ويشترط أن يكون الصرف ( تمليكا ) لا إباحة كما مر ( لا ) يصرف ( إلى بناء ) نحو ( مسجد و ) لا إلى ( كفن ميت وقضاء دينه ) أما دين الحي الفقير فيجوز لو بأمره ( شامى 2/344 )

A: The zakaat will not be fulfilled unless a poor student is made the owner of the item.

Using Zakaat Funds to Purchase Hampers and Feed Poor People

 

Q: Is it permissible to use zakaat funds to purchase hampers and feed the poor ? Similarly, is it permissible to provide iftaar for the poor in the month of Ramadhaan using zakaat funds?

A: It will be permissible to use zakaat funds to feed the poor provided the requirement of tamleek is found. Tamleek means to transfer ownership of the wealth to someone who is eligible for zakaat. Therefore if the poor  were given the zakaat hampers, the zakaat will be discharged. If the poor were not given the zakaat hampers but were merely invited for a meal and were allowed to partake of it, then zakaat will not be discharged since the requirement of tamleek was not found. Similar is the case regarding the iftaar food in the month of Ramadhaan. If the poor were given an iftaar hamper, the zakaat will be discharged. If the poor were not given the zakaat hampers but were merely invited to partake of the food provided, then the zakaat will not be discharged since the requirement of tamleek was not found.

قوله ( تمليكا ) فلا يكفي فيها الإطعام إلا بطريق التمليك ولو أطعمه عنده ناويا الزكاة لا تكفي (شامي 2/344)

Q: My question is about zakat for shops, like book stores, general stores, medical stores etc.

 

First question is, Zakat is payable on inventory in the shop or income of the shop??

Secondly, if it is on inventory or "goods for sale"  which goes up n down every month plus it is not possible to calculate the exact value of items then how to give zakat?

 

I am follower of fiqh Hanafi, so please guide me from that school of thoughts with reference.

Answer

In reference to your query, Zakat is calculated on the inventory (current market) value of the business stocks. If it is the case where the market value fluctuates throughout the year then the simplest method to calculate the amount of Zakat would be to evaluate the current market value upon the elapsing of a complete lunar year. To illustrate this, for instance the market value of a particular item was £100 at the beginning of Ramadhan 2014. The market value then increased to £150 by Ramadhan 2015 then the Zakat will be calculated on the value of £150. In short, the market value at the end of the year when Zakat is due is considered and not the fluctuating value throughout the year.

Q: Is zakaat waajib on properties, flats, etc?

A: Zakaat is not waajib on properties, etc. which are not purchased with the intention of resale. One will pay zakaat on the rentals received. However, if the properties were purchased with the intention of resale, then zakaat will be waajib on the market value of the properties.

( ولا في ثياب البدن ) المحتاج إليها لدفع الحر والبرد ابن ملك ( وأثاث المنزل ودور السكنى ونحوها ) وكذا الكتب وإن لم تكن لأهلها إذا لم تنو للتجارة. (شامي 2/265)

( وسبب لزوم أدائها توجه الخطاب ) يعني قوله تعالى { وآتوا الزكاة } وشرطه أي شرط افتراض أدائها ( حولان الحول ) وهو في ملكه ( وثمنية المال كالدراهم والدنانير ) لتعينهما للتجارة بأصل الخلقة فتلزم الزكاة كيفما أمسكهما ولو للنفقة ( أو السوم ) بقيدها الآتي ( أو نية التجارة ) في العروض إما صريحا ولا بد من مقارنتها لعقد التجارة كما سيجيء أو دلالة بأن يشتري عينا بعرض التجارة أو يؤاجر داره التي للتجارة بعرض فتصير للتجارة بلا نية صريحا واستثنوا من اشتراط النية ما يشتريه المضارب فإنه يكون للتجارة مطلقا (شامي 2/267)

Zakaat on Shares

 

Q: Is zakaat waajib on shares? If yes, then how will it be calculated?

A: Zakaat is Waajib on shares. However, it should be noted that Zakaat is not Waajib on the entire share. Rather Zakaat is only Waajib upon the Zakaatable assets of the company (i.e. the market value of the merchandise contained in the share of the company). As far as the non-Zakaatable assets of the company are concerned e.g. fixtures, fittings, transport vehicles, etc. which are not part of the merchandise of the company, the value of all these things will be evaluated in the share and will not be taken in account when discharging the zakaat. If it is difficult to differentiate between the zakaatable and non-Zakaatable assets of the company, then as a precautionary measure one should discharge the Zakaat on the market value of the entire share.

If a person purchased shares in a company that hires out vehicles, e.g. a trucking company or leases out properties, estates, flats, etc., Zakaat will not be Waajib on this type of share. Instead, Zakaat will only be Waajib on the profits accrued from the share.

Zakaat on Bad Debts

 

Q: What is the shar’iee ruling regarding a debt that is owed to a person who has no hope of receiving the money?

A: If the debtor blankly denies owing the creditor and there is no way to retrieve the money, then zakaat will not be waajib upon the debt. However, if he is unable to pay it due to financial constraints and wishes respite, then zakaat will be waajib on the debt.

(فلا زكاة على مكاتب)…(ودين) كان (جحده المديون سنين) ولا بينة له عليه (ثم) صارت له بأن (أقر بعدها عند قوم) وقيده في مصرف الخانية بما إذا حلف عليه عند القاضي أما قبله فتجب لما مضى (وما أخذ مصادرة) أي ظلما (ثم وصل إليه بعد سنين) لعدم النمو والأصل فيه حديث علي لا زكاة في مال الضمار وهو ما لا يمكن الانتفاع به مع بقاء الملك (ولو كان الدين على مقر مليء أو) على (معسر أو مفلس) أي محكوم بإفلاسه (أو) على ( جاحد عليه بينة) وعن محمد لا زكاة وهو الصحيح ذكره ابن ملك وغيره لأن البينة قد لا تقبل (أو علم به قاض) سيجيء أن المفتى به عدم القضاء بعلم القاضي (فوصل إلى ملكه لزم زكاة ما مضى) وسنفصل الدين في زكاة المال (شامي 2/266)

A. Paying taxes does not count as part of Zakaat. Zakaat is an Islamic obligation which has specific rules and regulations in regards to its calculation and disbursement. Zakaat bears no resemblance to government taxes.

How would a couple calculate Zakat on a joint account?

 

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

Primarily, each spouse is responsible to calculate and pay their own Zakāt.   However, one spouse may pay Zakāt on behalf of the other.

 

If the current share of one spouse in the balance can be determined on their Zakāt paying day, the spouse will be responsible to pay Zakāt on that amount.  He/she will add her share of the balance to one’s total gross assets when calculating Zakāt.  However, if each spouses’ current share cannot be determined, a husband and wife may treat the balance co-owned equally.  Thus, each spouse will be responsible to pay Zakāt on 50% of the balance.[1]

Giving someone Zakaat money to distribute

 

Q: I have a question about zakaat money. Every year I collect zakaat money from family and friends and distribute it to those that I know are deserving of it. I wanted to know if I can also take from the zakaat money for my own needs. My personal situation is that I believe that I am eligible for zakaat.

A: If people give you zakaat to distribute on their behalf to those who are deserving, then you cannot take the money for yourself even though you are eligible.

And Allah Ta'ala (الله تعالى) knows best.

وللوكيل أن يدفع لولده الفقير وزوجته لا لنفسه إلا إذا قال ربها ضعها حيث شئت (الدر المختار 2/ 269)

لو قال لرجل ادفع زكاتي إلى من شئت أو أعطها من شئت فدفعها لنفسه لم يجز وفي جوامع الفقه جعله قول أبي حنيفة وعند أبي يوسف يجوز ولو قال ضعها حيث شئت جاز وضعها في نفسه (حاشية الشلبي علي تبيين الحقائق 1/ 305)

Eating at a wedding function towards which one has given Zakaat
 
Q. Is it permissible for a person who is giving ZAKAT for the marriage of a girl to partake of the wedding food?
 
 
A. Yes. It is permissible. Once Zakaat funds have been given to the recipients of Zakaat, its status changes and it is no longer considered Zakaat. Hence if you partake of the food prepared, you will be eating from their Halaal wealth and not from Zakaat.
 
Sayyiduna Anas Radhiyallahu Anhu reports that once meat, given as Sadaqah to Bareerah Radhiyallahu Anha, was presented to Rasulullah Sallallahu Alayhi wa Sallam. Rasulullah Sallallahu Alayhi wa Sallam remarked, “It was Sadaqah for her but is now a Hadiyyah (gift) for us.” (Bukhari)

Is zakaat compulsory on an extra house

 

Q: Does a person have to pay zakaat on an extra house he bought and which is rented out? Similarly does one have to pay zakaat on the rent?

A: Zakaat is not payable on the extra house, but zakaat is payable on the rent received.

Delaying in discharging zakaat

 

Q: Is it necessary for one to spend all zakaat money before the following year's zakaat becomes waajib?

A: One should not delay in discharging one's zakaat. After calculating the zakaat on the zakaat date, one should begin discharging the zakaat. Before the following years zakaat date, all the zakaat should be discharged. If one delays in discharging the zakaat until after the following year's zakaat becomes compulsory, then one will be sinful.

( وافتراضها عمري ) أي على التراخي وصححه الباقاني وغيره ( وقيل فوري ) أي واجب على الفور ( وعليه الفتوى ) كما في شرح الوهبانية ( فيأثم بتأخيرها ) بلا عذر

قال الشامي : قوله ( وافتراضها عمري ) قال في البدائع وعليه عامة المشايخ ففي أي وقت أدى يكون مؤديا للواجب ويتعين ذلك الوقت للوجوب وإذا لم يؤد إلى آخر عمره يتضيق عليه الوجوب حتى لو لم يؤد حتى مات يأثم واستدل الجصاص له بمن عليه الزكاة إذا هلك نصابه بعد تمام الحول والتمكن من الأداء أنه لا يضمن ولو كانت على الفور يضمن كمن أخر صوم شهر رمضان عن وقته فإن عليه القضاء قوله ( وصححه الباقاني وغيره ) نقل تصحيحه في التاترخانية أيضا قوله ( أي واجب على الفور ) هذا ساقط من بعض النسخ وفيه ركاكة لأنه يؤول إلى قولنا افتراضها واجب على الفور مع أنها فريضة محكمة بالدلائل القطعية  وقد يقال إن قوله افتراضها على تقدير مضاف أي افتراض أدائها وهو من إضافة الصفة إلى موصوفها فيصير المعنى أداؤها المفترض واجب على الفور أي أن أصل الأداء فرض وكونه على الفور واجب وهذا ما حققه في فتح القدير من أن المختار في الأصول أن مطلق الأمر لا يقتضي الفور ولا التراخي بل مجرد الطلب فيجوز للمكلف كل منهما لكن الأمر هنا معه قرينة الفور الخ ما يأتي قوله ( فيأثم بتأخيرها الخ ) ظاهره الإثم بالتأخير ولو قل كيوم أو يومين لأنهم فسروا الفور بأول أوقات الإمكان وقد يقال المراد أن لا يؤخر إلى العام القابل لما في البدائع عن المنتقى بالنون إذا لم يؤد حتى مضى حولان فقد أساء وأثم اه فتأمل (رد المحتار 2/ 271)

Giving zakaat to an orphanage

 

Q: Can zakaat be given to an orphan shelter centre?

A: The fundamental requirement in the discharging of zakaat is the aspect of tamleek. Tamleek means to transfer ownership of the wealth to someone who is eligible for zakaat. Hence, if the wealth is not given to a recipient of zakaat, the zakaat will not be discharged. As far as giving the zakaat to an orphanage is concerned, then if the zakaat money is given to those orphans who are eligible to accept the zakaat (provided they have reached the age of understanding), then the zakaat will be discharged. Alternatively, the zakaat money can be given to their guardians to spend it on them.

ويشترط أن يكون الصرف ( تمليكا ) لا إباحة كما مر ( لا ) يصرف ( إلى بناء ) نحو ( مسجد)

قال الشامي : قوله ( تمليكا ) فلا يكفي فيها الإطعام إلا بطريق التمليك ولو أطعمه عنده ناويا الزكاة لا تكفي ط وفي التمليك إشارة إلى أنه لا يصرف إلى مجنون وصبي غير مراهق إلا إذا قبض لهما من يجوز له قبضه كالأب والوصي وغيرهما ويصرف إلى مراهق يعقل الأخذ كما في المحيط قهستاني (رد المحتار 2/ 344)

Is it permissible to give zakaat to Sayyids?

 

Q: Is it true that zakaat shouldn't be given to Sayyids. I wanted to give my yearly zakaat amount to one of my family relatives as they are very poor but my mom stopped me and told me that zakaat cannot be given to Sayyids. Is this true?

A: It is not permissible to give zakaat to Sayyids. However you may assist them with besides zakaat.

(لا) يصرف (إلى بناء) نحو (مسجد و)…. (و) لا إلى (من بينهما ولاد) ولو مملوكا لفقير (أو) بينهما (زوجية) ولو مبانة وقالا تدفع هي لزوجها… (و) لا إلى (غني) يملك قدر نصاب فارغ عن حاجته الأصلية من أي مال كان كمن له نصاب سائمة لا تساوي مائتي درهم…(و) لا إلى (طفله) بخلاف ولده الكبير وأبيه وامرأته الفقراء وطفل الغنية فيجوز لانتفاء المانع (و) لا إلى (بني هاشم) إلا من أبطل النص قرابته وهم بنو لهب فتحل لمن أسلم منهم كما تحل لبني المطلب ثم ظاهر المذهب إطلاق المنع وقول العيني والهاشمي يجوز له دفع زكاته لمثله صوابه لا يجوز نهر… (ولا) تدفع (إلى ذمي) لحديث معاذ (در المختار 2/ 344-350)

Q: Upon which wealth does a person have to pay zakaat?

 

A: Zakaat will be paid on the following:

  1. Cash (including the balance of your bank deposits).
  2. The market value of the merchandise contained in the share of the company i.e. one will be obligated to discharge the Zakaat of the company’s Zakaatable assets (merchandise) contained in the share excluding the non-Zakaatable items e.g. fixtures and fittings, transport vehicles, etc. which are not part of the merchandise of the company. The value of all these things will be evaluated in the share and will not be taken in account when discharging the zakaat. If it is difficult to differentiate between the zakaatable and non-Zakaatable assets of the company, then as a precautionary measure one should discharge the Zakaat on the market value of the entire share.
  3. Face value of the financial papers like bonds loaned to the government, etc. It should be noted that when the loan is paid back by the government, it will only be permissible for one to retrieve the original amount of the loan given. The interest amount paid out by the government will be impermissible. It will have to be given in sadaqah without the intention of receiving reward. Similarly, it should be known that it is impermissible for a believer to deal in any form of interest (usury) whether it be receiving or giving an interest bearing loan.
  4. The market rate of the balance of stock in trade (including raw material).
  5. Receivable amounts i.e. debts owed to a person, monies loaned to people, etc.
  6. Foreign currencies.
  7. Gold and silver.

(لا زكاة في اللآلىء والجواهر ) وإن ساوت ألفا اتفاقا ( إلا أن يكون للتجارة ) والأصل أن ما عدا الحجرين والسوائم إنما يزكى بنية التجارة (ج2 ص 273)

أو المستفاد ولو بهبة أو إرث وسط الحول يضم إلى نصاب من جنسه فيزكيه بحول الأصل (شامي 2/288)

نصاب الذهب عشرون مثقالا والفضة مئتا درهم ، كل عشرة دراهم وزن سبعة مثاقيل … إلخ (شامي 2/295)

(و) اعلم أن الديون عند الإمام ثلاثة قوي ومتوسط وضعيف (فتجب) زكاتها إذا تم نصابا وحال الحول لكن لا فورا بل (عند قبض أربعين درهما من الدين) القوي كقرض (وبدل مال تجارة) فكلما قبض أربعين درهما يلزمه درهم (و) عند قبض (مائتين منه لغيرها) أي من بدل مال لغير تجارة وهو المتوسط كثمن سائمة وعبيد خدمة ونحوهما مما هو مشغول بحوائجه الأصلية كطعام وشراب وأملاك ويعتبر ما مضى من الحول قبل القبض في الأصح ومثله ما لو ورث دينا على رجل (و) عند قبض (مائتين مع حولان الحول بعده) أي بعد القبض (من) دين ضعيف وهو (بدل غير مال) كمهر ودية وبدل كتابة وخلع

قوله (في الأصح) قد علمت أنه ظاهر الرواية وعبارة الفتح و البحر في صحيح الرواية قلت لكن قال في البدائع إن رواية ابن سماعة أنه لا زكاة فيه حتى يقبض المائتين ويحول الحول من وقت القبض هي الأصح من الروايتين عن أبي حنيفة اهـ ومثله في غاية البيان وعليه فحكمه حكم الدين الضعيف الآتي (شامي 2/305)

Q: Is zakaat waajib on redundant stock?

 

A: If redundant stock refers to that stock which one is unable to sell quickly but is kept with the intention of resale, then zakaat is waajib on such goods. And if redundant stock refers to that stock which one no longer intends to sell, then this wealth no longer remains stock of trade. Hence, zakaat will not be compulsory upon it.

 

( لا يبقى للتجارة ما ) أي عبد مثلا ( اشتراه لها فنوى ) بعد ذلك ( خدمته) (شامي 2/272)

Zakaat to ones in-laws
 
Q. Is it permissible to give Zakaat to ones father-in-law, mother-in-law, son-in-laws, daughter-in-laws? Can one give Zakaat to ones brothers, sisters, uncles and aunts?
 
A. It is permissible to give Zakaat to ones In-laws i.e. father-in-law, mother-in-law, son-in-law’s, daughter-in-law’s and so on. It is also permissible to give Zakaat to ones brothers, sisters, uncles and aunts. In fact, ones close family relatives should be given preference over others in discharging Zakaat.
 
This is on condition that the above people are eligible recipients of Zakaat.

Zakaat given under the Pretext of a Gift or a Loan

 

Q: Will the zakaat be fulfilled if it is given under the pretext of a gift or a loan?

A: If the person discharging the zakaat has the intention of zakaat at the time he gifted the wealth or loaned it to the poor person, the zakaat will be discharged. However, in the case where he gave the zakaat as a loan it is impermissible for him to take back the wealth. If he takes it back he will be sinful.

قوله ( نية ) أشار إلى أنه لا اعتبار للتسمية فلو سماها هبة أو قرضا تجزيه في الأصح ( شامى 2/268)
