Can you please answer the questions below with regards to fasting?

        In the name of Allah, Most Compassionate, Most Merciful,

Q: Is taking a meal before commencing a fast (suhur) necessary in order for a fast to be valid?
 

A: No, Suhur is not necessary. However, it is a virtuous act of Sunnah that should not be missed unnecessarily.

Q: What time does Suhur begin?
 

A: One can take Suhur any time after midnight, but it is more advisable to take it in the latter hours of the night, preferably just before the break of true dawn (al-Fajr al-Sadiq).

Q: Is an intention for fasting necessary and when should one make the intention (niyyah) for the fast of Ramadhan?
 

A: The intention for fasting is necessary but very simple: It is to know in your heart that you will fast that day. It is valid to have this intention any time from Maghrib the night before up to the Islamic midday of the actual day of fasting, for current Ramadhan fasts and voluntary fasts. The Islamic midday is half way between the beginning of Fajr and Maghrib times. (al-Fatawa al-Hindiyya)

Q: Can a man have sexual intercourse with his wife during the nights of Ramadhan?
 

A: Yes, it is permitted to have sexual intercourse with one’s spouse during the nights of Ramadhan. However, one must stop before the break of dawn (al-Fajr al-Sadiq). It will also be permitted to take the obligatory ritual bath of purification after one has started one’s fast.

Q: Is it permissible to kiss and caress one’s wife whilst fasting?
 

A: Non-sexual affectionate kissing, from which there is no fear of leading to intercourse or ejaculation, will be allowed and not disliked. However, if one fears that kissing will lead to ejaculation or sexual intercourse, then it will be disliked (makruh) to kiss, but one’s fast will remain valid as long as kissing does not lead to actual sexual intercourse or does not result in ejaculation. If kissing resulted in ejaculation, one’s fast would become invalid and hence will have to be made up (qadha), without having to expiate for it (kaffara). Passionate kissing when saliva is exchanged will invalidate one’s fast, with both Qadha and Kaffara necessary. (al-Fatawa al-Hindiyya, 1/200 & 1/204)

Q: Does a fast break when one swallows the saliva of one’s spouse?
 

A: Yes, if one is certain of swallowing one’s spouse’s saliva, then this would invalidate one’s fast and necessitate both a Qadha and Kaffara.

Q: If one kisses or caresses one’s spouse and consequently ejaculates, is one’s fast broken?
 

A: Yes, the fast is invalidated. However one will only have to make up for the fast (Qadha), and there will be no expiation (Kaffara) in this situation.

Q: What is the difference between a Qadha and Kaffara?
 

A: Qadha (makeup) means to keep another fast in order to make up for the fast which was invalidated, whilst Kaffara (expiation) means to perform an act to expatiate the sin of having broken a fast.

Q: In what way is a Kaffara fulfilled?
 

A: A Kaffara may be given in the following two ways: 1) Fasting for two months consecutively without missing a single fast, 2) Feeding sixty poor people. It should be remembered that if one has the ability to fast then one cannot adopt the second method; rather, one will have to fast for sixty days continuously.

Q: Does an injection invalidate one’s fast?
 

A: No, it does not invalidate one’s fast, although it is better to avoid taking injections whilst fasting unnecessarily.

Q: Does taking out blood or a blood test invalidate one’s fast?
 

A: No, a blood test does not invalidate the fast, as it is merely the taking out of blood. However, it will be disliked if it could weaken one from being able to maintain the fast.

Q: Does smoking invalidate one’s fast?
 

A: Yes, it does invalidate one’s fast. (Ramadhan is a good time to quit smoking forever!).

Q: Is it allowed to use an Asthma Pump during the Fast?
 

A: If one has a genuine medical need for an asthma pump that cannot be otherwise fulfilled, then it would be permitted to use it. However, it would break the fast and require that the fast be made up later (Qadha). This is because anything that has a perceptible body breaks the fast if it enters the body through a normal channel.

Q: When does vomiting break one’s fast?
 

A: Vomiting only breaks one’s fast if: a) one returns and swallows the vomit down the throat, or b) one vomits a mouthful intentionally. It is not broken by non-deliberate vomiting or (deliberately) vomiting less than a mouthful. If one’s fast is broken by vomiting, then one will only have to make up (qadha) for the fast, a Kaffara will not be necessary.

Q: How does one decide when vomiting is a mouthful?
 

A: The definition of “mouthful vomiting” is that which one cannot hold back in one’s mouth without difficulty.

Q: Can one fast whilst travelling?
 

A: Yes, one may fast while travelling. However one should not burden oneself if the journey is long and difficult, for in such situations it is advisable not to fast.

Q: Can a woman on menstruation (haydh) or post-natal bleeding (nifas) fast?
 

A: No, she cannot fast. It will be unlawful (haram) for her to do so.

Q: Does a woman on menstruation (Haydh) or post-natal bleeding (Nifas) have to make up for the fasts missed?
 

A: Yes, she will have to make Qadha for the missed fasts.

Q: Does one have to perform the Qadha fasts immediately after Ramadhan?
 

A: No, it is not necessary. However, it is recommended to complete the missed fasts of Ramadhan as soon as possible.

Q: When can a sick person break his/her fast on the opinion of a doctor?
 

A: When a competent Muslim doctor says that if he/she continues fasting, it will bring danger to his/her life or severely effect the health, then in such a situation it will be permitted to break one’s fast. One will not be liable for a Kaffara but will only have to make up for the fast (Qadha).

Q: Is it permissible to insert medicine through a female’s vagina during a fast?
 

A: Any form of medicine inserted into the internal part of a woman’s vagina will invalidate her fast.

Q: To whom does the Ayat of fasting apply?

A: Fasting is an act of worship (ibadat). It is one of the Fundamental Principles (Pillars) of Islam. Allah says:”Oh you who believe fasting is prescribed for you as it was prescribed to those before you that you may attain Taqwa (God-Fearing).”Allah says Oh you who believe. This is a general command for everyone who is Believers in Islam.

 

Q: Does a minor child have to fast?

A: Fasting is not obligatory on a minor. A minor is he who is not physically matured (Baaligh) in the case of a male and in the case of a female, she has not attained puberty. However, if by the age of 15 lunar years, the male or female did not become baaligh, they will be regarded as adults and have to fast and fulfil all obligations of Shariah.

 

Q: Does a sick person have to fast?

A: A sick person is exempted from fasting altogether if there is genuine reason to believe that the current illness will intensify by fasting or that he will suffer another illness on result of fasting or that his recovery will be prolonged due to fasting.

 

Q: Can a traveller omit fasting?

A: A Shar’ī musāfir (traveller) who embarked on his journey prior to dawn is permitted to omit the fast of that day.  As long as he is a Shar’ī musāfir, he may omit fasting.

 

Q: What about travelling during the day?

A: If a person embarked on a journey during the day after Subh Sadiq, he/she will have to fast that day.

 

Q: Will the application of eye drops break the fast?

A: Using eyedrops will not break the fast.

 

Q: Can ear drops be used?

A: If a person’s eardrum is imperforated, he may use ear drops.  If someone has perforated ear drums, it will not be permissible to use ear drops.

 

Q: Can we use insulin injections whilst fasting?

A: It is permissible to use insulin injections.  Injections do not break a fast.

 

Q: Will a nasal spray break the fast?

A: Yes, a nasal spray will break the fast.

 

A: Can mouthwash be used whilst fasting?

Q: It is not permissible to use mouthwash whilst fasting.

 

Q: Is it permissible to brush teeth and use toothpaste?

A: It is not permissible to use toothpaste whilst fasting.  One may brush teeth, use a miswak and a tongue scraper.

 

Q: Can an addicted smoker smoke whilst fasting?

A: It is not permissible to smoke whilst fasting.  Smoking will result in Qadhā and Kaffārah.  A smoker may use a transdermal nicotine patch.

 

Q: What is the ruling for using suppositories?

A: Insertion of suppositories up the rear passage will invalidate the fast.

 

Q: I forgetfully ate whilst fasting?

A: If one was totally unaware that he was fasting, the fast will not be broken regardless of what was consumed.

 

Q: By mistake I swallowed water whilst doing wudhu?

A: By doing an act mistakenly will break one’s fast.  However, only Qadhā will be necessary.

 

Q: What if a person must break the fast due to an asthma attack?

A: If a person suffers from an illness or has an asthma attack and there is no option but to have medicine or an inhaler, it will be permissible to break the fast.  However, he will have to do Qadhā.

 

Q: I engaged in intercourse with my spouse?

A: Intercourse will invalidate the fast and will make Qadhā and Kaffārah compulsory.

 

Q: I had a wet dream whilst fasting.  Is my fast broken?

A: A wet dream will not invalidate the fast.

 

Q: What is the Kaffārah?

A: A Kaffārah is expiation for a violation.  It is fasting for 60 days consecutively without any interruption for those capable of fasting.  If one cannot fast, he will have to give monetary Kaffarah.

 

Q: When will Kaffārah be binding?

A: Kaffarah becomes binding if one deliberately breaks his fast by eating or drinking or having intercourse.

 

Q: Can a sick person pay fidyah instead of fasting?

A: A person who cannot fast due a chronic or terminal illness may give fidyah.  As long as a person’s condition remains such that they cannot fast, they will keep giving fidyah for each fast.

If there is improvement to such a degree that they can fast, they will have to do Qadhā of all the previous fasts.  The value of fidya is the same as that of sadaqah al-fitr which is presently R16 for the people in South Africa.

Traveling & Fasting

 

A: It is compulsory for a person who is present in his hometown at the time of Subh Sadiq to fast. Since he only intends travelling during the course of the day the concession of not fasting does not apply to him. Hence, if he does not keep the fast he will be sinful. (Ahsanul Fataawa vol.4 pg. 447)

ومنها السفر الذي يبيح الفطر وهو ليس بعذر في اليوم الذي أنشأ السفر كذا في الغياثية فلو سافر نهارا لايباح له الفطر في ذلك اليوم وإن أفطر لا كفارة عليه بخلاف ما لو أفطر ثم سافر كذا في محيط السرخسي (الفتاوى الهندية ج1 ص206)

(وللمسافر الذي أنشا السفر قبل طلوع الفجر إذ لايباح له الفطر بإنشائه بعد ما أصبح صائما بخلاف ما لو حل له مرض بعده فله (الفطر) لقوله تعالى فمن كان منكم مريضا أو على سفر فعدة من أيام أخر … (وصومه) أي المسافر (أحب إن لم يضره) لقوله تعالى: ,أن تصوموا خير لكم (مراقي الفلاح ص686)

Q: Whilst fasting, if the nose begins to bleed, will the fast break?

 

A: The fast will not break by mere nose bleeding. If the blood flowed down the nasal passage and entered the throat then it will be seen whether the blood was more than the saliva or less than it. If the blood was more than the saliva or equal to it then the fast will break. If the blood was less than the saliva then the fast will not break. (Ahsanul Fataawa vol.4 pg.436, Fataawa Raheemiyyah vol.7 pg.258, Bahishti Zewar vol.3 pg.13)

 

ولو أكل دما في ظاهر الرواية عليه القضاء دون الكفارة لأنه مما يستقذره الطبع كذا في الظهيرية (الفتاوى الهندية ج1 ص203)

وما وصل إلى الجوف أو إلى الدماغ من المخارق الأصلية كالأنف والأذن والدبر بأن استعط أو احتقن أو أقطر في أذنه فوصل إلى الجوف أو إلى الدماغ فسد صومه (بدائع الصنائع ج 2 ص 93)

Ghusl of Janabah
 
Q. Can one take a bath after Sehri, to be cleared from the state of Janaabat (requiring a Fardh Ghusal)?
 
A.It is not advisable to unnecessarily delay the Fardh Ghusl. However if one is in the position that he wants to partake of Sehri before taking the Ghusl, it will be permissible. Rasulullah (Sallallahu Alaihi Wasallam) had sometimes delayed the Fardh Ghusl till after Suhoor. (Fathul Mulhim, V: 5, P: 226, Darul Qalam)

Q. Does the application of ointments like deep heat and therapeutic oils on the skin break the fast?

Virtue of Sehri
 
QMufti Saheb. The Month of Ramadaan is at our doorstep and we will soon be fasting Inshallah. With regards to Sehri, I wanted to know the virtue of it? Also, if it is missed, will the fast be valid?

A. It is Mustahab (preferable) to partake of Sehri (Shaami). Rasulullah Sallallahu Alayhi Wa Sallam said:
 
“Partake of Sehri, for verily there is Barakah (blessings) in Sehri”(Bukhari)
 
However, if one does not partake of Sehri or misses it, the fast will still be valid.

Time of Sehri

 

Q. I have read the Jamiatul Ulama KZN’s previous Q&A on the virtue of partaking of the pre-dawn meal (Sehri). Since then, I have the desire to partake of Sehri during the month of Ramadaan. What time should I partake of Sehri?
 
 
A. There is no specific time for the beginning of Sehri. However to delay the eating of Sehri until before the Subah Sadiq (break of dawn) is Mustahab (preferable). (Hindiyyah)
 
By delay it is not meant that one eats right up to last moments. Rather it refers to not eating during the early portion or middle of the night, but towards the latter portion. One should complete the Sehri comfortably before the cut off time.

Delaying Iftaar till the completion of Azaan
 
Q. Does the time of Iftaar only commence after the completion of Azaan? I have been to some Masaajid in which Iftaar only commences after the completion of Azaan?

A. The end of a fast (Iftaar) is at sunset time. (Kifaayatul Mufti 4/249)
 
Accordingly, a fasting person should end his fast at sunset which is generally the time that Azaan commences and should not delay it until the completion of the Azaan. Rasulullah Sallallahu Alayhi wa Sallam said:
 
“The people will remain on the right path as long as they hasten in breaking the fast.” (Bukhari)

Wearing Pain Patch while Fasting?
 
Question

One of my friends has to wear a pain patch always because without the patch, she would be in a lot of pain. This patch helps her and reduces her pain because once she was attacked and because of that incident she had to take 2 operations and now the doctors have told her to wear this pain patch. She is confused about the fact that wether or not it is permissible to wear it while fasting? Some people said yes to her and some no. Could you plz answer soon because ramazan is coming and she needs to know urgent.

 

Answer

A pain patch is used externally, hence, will not invalidate the fast. Your friend may fast in the month of Ramadhaan while using the pain patch.

Wearing Nicotene Patch while Fasting?

Assalamualaykum Q-A person who is fasting wheres a Nicotene patch on the arm is fast valid?(A nicotine patch is a transdermal patch that releases nicotine into the body through the skin. It is usually used as a method to quit smoking.)

Yes, this will not affect the fast.

Eye drops and contact lenses while fasting

 
Q. Whilst fasting, is it okay for me to use contact lenses? Can I also apply eye drops in my eyes whilst fasting?

A. The usage of contact lenses and eye drops in the eyes whilst fasting does not invalidate the fast. Accordingly, you may make use of contact lenses and eye drops in the eyes while fasting. (Al Bahrur-Ra’iq, 2/273)

Fasting for one Commencing a Journey in Ramadhaan

 

Q: A person intends travelling during the course of the day and at the time of Subh Sadiq (when the fast commences) he is still in his hometown? Is it permissible for him not to fast?

A: It is compulsory for a person who is present in his hometown at the time of Subh Sadiq to fast. Fasting whilst on a Journey

 

Q: Is it compulsory for a Musaafir to fast whilst on a journey?

A: It is not compulsory for a Musaafir to fast whilst on a journey. Sharee’at has granted him a concession not to fast and to make up for the missed fast upon returning home after the month of Ramadhaan. However, if the Musaafir is able to fast during his journey then this is more rewarding.

و يندب لمسافر الصوم إن لم يضره فإن شق عليه أو على رفيقه فالفطر أفضل (الدر المختار ج2 ص42)

ومنها السفر الذي يبيح الفطر وهو ليس بعذر في اليوم الذي أنشأ السفر كذا في الغياثية (الفتاوى الهندية ج1 ص206)

Cooking on an open fire whilst Fasting

 

Q: What is the shar’ee ruling regarding a person who cooks on open fire? Will the smoke unintentionally inhaled whilst fasting nullify his fast?

A: The smoke inhaled unintentionally whilst cooking will not nullify the fast.

(أو دخل حلقه غبار أو ذباب أو دخان ) ولو ذاكرا استحسانا لعدم إمكان التحرز عنه ومفاده أنه لو أدخل حلقه الدخان أفطر أي دخان كان ولو عودا أو عنبرا لو ذاكرا لإمكان التحرز عنه قال في الشامي: أي بأي صورة كان الإدخال حتى لو تبخر ببخور فآواه إلى نفسه واستمه ذاكرا لصومه أفطر لإمكان التحرز عنه (رد المحتار على در المختار ج2 ص395)

(أو دخل حلقه دخان بلا صنعه) لعدم قدرته على الامتناع عنه فصار كبلل بقي في فمه بعد المضمضة لدخوله من الأنف إذا أطبق الفم وفيما ذكرنا إشارة إلى من أدخل بصنعه دخانا حلقه بأي صورة كان الإدخال فسد صومه سواء كان دخان عنبر أو عود أو غيرهما (مراقي الفلاح ص660)

Burning Lawbaan or any other Incense Sticks whilst Fasting

 

Q: Is it permissible for a person whilst fasting to scent the musjid through burning lawbaan or any other incense sticks?

A: It is makroo for a fasting person to burn lawbaan or incense sticks in the musjid or anywhere else, due to the fear that he will inhale the smoke. Inhaling the smoke intentionally will nullify the fast.

Cupping whilst Fasting

 

Q: If a person undergoes cupping whilst fasting does the fast become nullified?

A: Undergoing cupping whist fasting does not nullify the fast. However, if through past experiences one knows that cupping causes physical weakness then in that case it will be Makrooh to undergo cupping whilst fasting.

(أو اكتحل أو احتجم … وسيأتي أن كلا من الكحل والدهن غير مكروه وكذا الحجامة إلا إذا كانت تضعفه عن الصوم (رد المحتار على در المختار ج2 ص395 و396)

(أو احتجم) لم يفسد وتكره الحجامة للصائم إذا كانت تضعفه أما إذا كان لايخافه فلا بئس به (حاشية الطحطاوي على مراقي الفلاح ص660)

Smoking an e-cigarette while fasting
 
Q. There is a new craze of smoking the e-cigarettes, twisps etc. What is the ruling of smoking these types of electronic cigarettes etc. whilst fasting?

A. The usage of an electronic cigarette whilst fasting will nullify the fast as the usage of an e-cigarette entails the inhaling of vapour that nullifies the fast. (Tahtaaawi Ala Maraqil Falaah 660)

Bleeding Gums whilst Fasting

 

Q: Whilst fasting, if the gums begin to bleed and the blood flows down the throat will the fast break? If so will both Qadha and Kaffarah be Waajib or only Qadha?

A: If the blood which was swallowed with the saliva was more than the saliva or equal to it then the fast will break and only qadha will be waajib. If the blood was less than the saliva then the fast will not break. (Ahsanul Fataawa vol.4 pg.436, Fataawa Raheemiyyah vol.7 pg.258, Bahishti Zewar vol.3 pg.13)

خرج الدم من بين أسنانه ودخل حلقه يعني ولم يصل إلى جوفه أما إذا وصل فإن غلب الدم أو تساويا فسد وإلا لا … قال الشامي: قلت ومن هذا يعلم حكم من قلع ضرسه في رمضان ودخل الدم إلى جوفه في النهار ولو نائما فيجب عليه القضاء (رد المحتار على در المختار ج2 ص396)

Using an Inhaler (pump) whilst Fasting

 

 

Q: Is it permissible for an asthma patient to use an inhaler (pump) whilst fasting? The inhaler contains salbutamol (liquid medication). Will Qadha and Kaffarah become Waajib or only Qadha?

 

 

A: Using the pump whilst fasting will break the fast since it contains medication. Only Qadha will be Waajib.

Breaking a Fast on the Advise of a Doctor

 

Q: A person whilst fasting had fallen ill. The doctor advised him to break his fast. Is he sinful for doing so and will both Qadha and Kaffarah be Waajib or only Qadha?

A: If he is unable to continue with the fast it will be permissible for him to break the fast and only Qadha will be Waajib.

المريض إذا خاف على نفسه التلف أو ذهاب عضو يفطر بالإجماع وإن خاف زيادة العلة وامتداده فكذلك وعليه القضاء إذا أفطر كذا في المحيط (الفتاوى الهندية ج1 ص207)

( أو مريض خاف الزيادة ) لمرضه (الدر المختار 2/422-فصل في العوارض المبيحة لعدم الصائم)

Water goes down the Throat when Gargling or Rinsing the Nose whilst Fasting

 

Q: If whilst fasting, water goes down the throat when gargling the mouth or rinsing the nose in Wudhu or Ghusl will the fast break?

A: If one was aware that he was fasting at the time the water seeped down the throat or nostril the fast will break. If one was unaware of him being in the state of fasting the fast will not break.

(وإن أفطر خطأ كأن تمضمض فسبقه الماء قال في الشامي: (قوله وإن أفطر خطأ) شرط جوابه قوله التي قضى فقط وهذا شروع في القسم الثاني وهو ما يوجب القضاء دون الكفارة … (قوله فسبقه الماء) أي يفسد صومه إن كان ذاكرا له (رد المحتار على در المختار ج2 ص401)

وإن تمضمض أو استنشق فدخل الماء جوفه إن كان ذاكرا لصومه فسد صومه وعليه القضاء (الفتاوى الهندية ج1 ص203)

Eating Intentionally after thinking one's Fast has Broken

 

Q: After eating forgetfully a fasting person intentionally ate assuming that his fast had already broken. Does the fast now become nullified? If so will Qadha as well as Kaffarah become Waajib or only Qadha?

A: The fast will now become nullified. Only Qadha will be Waajib. (Bahishti Zewar vol.3 pg.13)

(وإن أفطر خطأ ) كأن تمضمض فسبقه الماء أو شرب نائما أو تسحر أو جامع على ظن عدم الفجر ( أو ) أوجر ( مكرها ) أو نائما وأما حديث رفع الخطأ فالمراد رفع الإثم وفي التحرير المؤاخذة بالخطأ جائزة عندنا خلافا للمعتزلة ( أو أكل ) أو جامع ( ناسيا ) أو احتلم أو أنزل بنظر أو ذرعه القيء ( فظن أنه أفطر فأكل عمدا ) للشبهة ، قال الشامي: (قوله للشبهة) علة للكل قال في البحر: وإنما لم تجب الكفارة بإفطاره عمدا بعد أكله أو شربه أو جماعه لأنه ظن في موضع الاشتباه بالنظير (رد المحتار على در المختار ج2 ص401/402)

لو أكل أو شرب أو جامع ناسيا وظن أن ذلك فطره فأكل متعمدا لاكفارة عليه (الفتاوى الهندية ج1ص206)

A: Smoking nullifies the fast. Both Qadha and Kaffarah become Waajib.

ومفاده أنه لو أدخل حلقه الدخان أي دخان كان ولو عودا أو عنبرا لو ذاكرا لإمكان التحرز عنه قال في الشامي: اي بأي صورة كان الإدخال حتى لو تبخر ببخور فآواه إلى نفسه واشتمه ذاكرا لصومه أفطر لإمكان التحرز عنه (رد المحتار على در المختار ج2 ص395)

ويظهر من ذلك أن مرادهم بما يتغذى به ما يكون فيه صلاح البدن بأن كان مما يؤكل عادة على قصد التغذي أو التداوي أو التلذذ (رد المحتار على در المختار ج2 ص410)

(أو دخل حلقه دخان بلا صنعه لعدم قدرته على الامتناع عنه فصار كبلل بقي في فمه بعد المضمضة لدخوله من الأنف إذا أطبق الفم وفيما ذكرنا إشارة إلى من أدخل بصنعه دخانا حلقه بأي صورة كان الإدخال فسد صومه سواء كان دخان عنبر أو عود أو غيرهما (مراقي الفلاح ص660)
