Procedure for asking the husband for a divorce

 

Q: Kindly explain the rules of a woman asking for a divorce.

 

A: One should adopt all halaal means and ways in trying to resolve the marital disputes and misunderstandings. If one is able to speak to one's husband directly and thereby reach some resolution in amicably settling the marital problems, then one should do so. If this is not possible, then one should refer the matter to a third person or a third party and ask them to assist in bringing about a reconciliation. If reconciling is not possible and the wife is sure that she cannot manage to continue with the nikaah and she knows that later on she will not have any regrets over her decision, then she may seek talaaq from her husband.

And Allah Ta'ala (الله تعالى) knows best.

الطَّلَاقُ مَرَّتَانِ ۖ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ ۗ وَلَا يَحِلُّ لَكُمْ أَن تَأْخُذُوا مِمَّا آتَيْتُمُوهُنَّ شَيْئًا إِلَّا أَن يَخَافَا أَلَّا يُقِيمَا حُدُودَ اللَّـهِ ۖ فَإِنْ خِفْتُمْ أَلَّا يُقِيمَا حُدُودَ اللَّـهِ فَلَا جُنَاحَ عَلَيْهِمَا فِيمَا افْتَدَتْ بِهِ ۗ تِلْكَ حُدُودُ اللَّـهِ فَلَا تَعْتَدُوهَا ۚ وَمَن يَتَعَدَّ حُدُودَ اللَّـهِ فَأُولَـٰئِكَ هُمُ الظَّالِمُونَ ﴿البقرة: ٢٢٩﴾

وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِّنْ أَهْلِهِ وَحَكَمًا مِّنْ أَهْلِهَا إِن يُرِيدَا إِصْلَاحًا يُوَفِّقِ اللَّـهُ بَيْنَهُمَا إِنَّ اللَّـهَ كَانَ عَلِيمًا خَبِيرًا ﴿النساء: ٣٥﴾
