Q: Is it permissible to give Zakah to someone in the form of food vouchers instead of cash?

 

الجواب حامدا ومصليا ومنه الصدق والصواب

 

A: It is permissible to give food vouchers instead of cash.  However, the Zakah will only be discharged once the recipient receives the food.  A food voucher is an assignment of debt against the issuer of the food voucher (food provider) and is not wealth in itself.  Thus, the receipt of the food voucher by the recipient does not discharge the obligation of Zakah.  Upon receipt of the food the recipient possesses the food on behalf of the transferor (i.e., person giving the voucher) and then for him/herself.

 

ففى رد المحتار:  وفى صورتين لا يجوز: الأولى أداء الدين عن العين كجعله ما فى ذمة مديونه زكاة لماله الحاضر ، بخلاف ما إذا أمر فقيرا بقبض دين له على آخر عن زكاة عين عنده فإنه يجوز لأنه عند قبض الفقير يصير عينا فكان عينا عن عين.  (كتاب الزكاة ، 2/270-271)

وفيه:  (قوله: ولا يجوز من غيره) أى لا يجوز تمليك الدين من غير من عليه الدين ، إلا إذا سلطه عليه ، واستثنى فى الأشباه من ذلك ثلاث صور.  الأولى: إذا سلطه على قبضه ، فيكون وكيلا قابضا للمولى ثم لنفسه ، الثانية: الحوالة ،الثالثة: الوصية.  (كتاب البيوع ، باب المرابحة والتولية ، فصل فى التصرف فى المبيع والثمن قبل القبض والزيادة ، 5/152-153)

Q: Is the responsibility of Zakat a strictly individual responsibility or can it be joint say in the case of husbands and wives?

 

الجواب حامدا ومصليا ومسلما ومنه الصدق والصواب

 

A: Zakat is strictly a personal obligation.  Even in jointly owned wealth the obligation of zakat remains personal.  Thus, if a husband and wife jointly own a zakatable asset, zakat will only be payable for each if his/her ownership proportion reaches the level of nisab, either of itself or in conjunction with his/her other zakatable asset/s if any. However, the husband and wife may agree to pay the zakat of each other.

When will Zakaat be Obligatory?

 

 

Q: When will zakaat be obligatory and how should one work out one's zakaat date?

A: The first day a person acquires wealth (upon which zakaat is compulsory) which equals the nisaab and the wealth remains with him for an entire lunar year, zakaat will be waajib on that wealth.

E.g. Zaid acquired R3, 000 (which for example is the nisaab amount) on the first day of the lunar year (1st of Muharram 1434). This wealth remained with him for an entire lunar year. On the 1st of Muharram 1435 zakaat will be waajib upon the wealth. It should be noted that if the amount decreased during the course of the year e.g. R3, 000 decreased to R1, 000 but at the end of the zakaat year (1st of Muharram 1435) the amount returned to R3, 000 or more, zakaat will be waajib. However, if during the year all the money was spent, then despite the full amount (R3, 000) being possessed at the end of the lunar year, zakaat will not be waajib. Instead one year will be calculated from the date that he once again acquired the nisaab amount.

(وشرط كمال النصاب) ولو سائمة (في طرفي الحول) في الابتداء للانعقاد وفي الانتهاء للوجوب (فلا يضر نقصانه بينهما) فلو هلك كله بطل الحول

 

قوله: (وشرط كمال النصاب إلخ) أي ولو حكما، لما في البحر والنهر، لو كان له غنم للتجارة تساوي نصابا فماتت قبل الحول فدبغ جلودها وتم الحول عليها كان عليه الزكاة إن بلغت نصابا، ولو تخمر عصيره الذي للتجارة قبل الحول ثم صار خلا وتم الحول عليه وهو كذلك لا زكاة عليه؛ لأن النصاب في الأول باق لبقاء الجلد لتقومه بخلافه في الثاني. وروى ابن سماعة أنه عليه الزكاة في الثاني أيضا قوله: (للانعقاد) أي انعقاد السبب أي تحققه بتملك النصاب ط قوله: (للوجوب) أي لتحقق الوجوب عليه ط قوله: (فلو هلك كله) أي في أثناء الحول بطل الحول، حتى لو استفاد فيه غيره استأنف له حولا جديدا وتقدم حكم هلاكه بعد تمام الحول في زكاة الغنم. قال في النهر: ومنه أي من الهلاك ما لو جعل السائمة علوفة؛ لأن زوال الوصف كزوال العين (شامي 2/302)

Aapa,

 

This is very hard to tell as to how has designed this application and also it costs money £ 0.69 to download. I don't have an iPhone to download this so can't tell if its good or not.

 

All other free Zakat Aaps also cannot be verified.

Zakah (alms) is one of the five pillars of Islam. Its importance can be realised from the fact that in 82 verses of the Qur'an Zakah is associated with prayer (Salah), such as:


“Establish regular prayer and give Zakah; and obey Allah and His Messenger.” Quran (33:33)


If social justice and compassion to fellow humans who are disadvantaged is one of the central themes in the message of Allah to humanity, then it is no wonder that Zakah, like prayer and fasting, was also enjoined upon the people of the past messengers:


And We made them (descendants of Abraham) leaders, guiding by Our command, and We sent them inspiration to do good deeds, to establish regular Prayers and to practise Zakah; and they constantly served Us” -Quran (21:73)


 


THE WISDOM OF GIVING ZAKAH


·         It purifies your wealth as Allah Ta’ala says in the Qur'an: Take alms from their wealth in order to purify them and sanctify them with it and pray for them.” Quran (9:103)


  • It reminds Muslims of the fact that whatever wealth they may possess is due to the blessings of Allah and as such it is to be spent according to the His commands.
  • Zakat functions as a social security for all. Those who have enough money today pay for what they have. If they need money tomorrow they will get what is necessary to help them live decently. Zakat payer pays his dues to Allah as an act of worship, a token of submission and an acknowledgment of gratitude. The receiver of Zakat receives it as a grant from Allah out of His bounty, a favor for which he is thankful to Allah.

  • Economically, Zakat is the best check against hoarding. Those who do not invest their wealth but prefer to save or hoard it would see their wealth dwindling year after year due to inflation etc. Zakah helps increase production and stimulates supply because it is a redistribution of income that enhances the demand by putting more real purchasing power in the hands of poor.

  • It keeps one away from sin and saves the giver from the moral ill arising from the love and greed of wealth.

·         Through Zakah, the poor are cared for, these include widows, orphans, the disabled, the needy and the destitute.


 


Zakah is the right of the poor. Zakah is not considered a favour that is given to the poor by the rich. It is the right of the poor on the wealth of the rich. Allah says: ..(In their) wealth there is a known share for the beggars and the destitute”Quran (70:24-25)


 


Zakah, therefore, is unlike charity that is given to the needy voluntarily. Withholding Zakah is considered depriving the poor of their due share. Thus one who pays Zakah actually "purifies" his wealth by separating from it the portion that belongs to the poor.


 


VIRTUES OF ZAKAH


Allah says in the Quran: "The parable of those who spend their wealth in the way of Allah is that of a grain of corn. It grows seven ears and each ear has hundred grains. Allah increases manifold to whom He pleases." (Quran 2:261)


 


The Beloved Messenger of Allah (pbuh) is reported to have said about Zakah:


·         Zakah is a (great and strong) bridge of Islam.


·         If a man pays the Zakah due on his property, it causes its evil influence to vanish.


·         Gains the pleasure of Allah.


·         Increases wealth and protects from losses.


·         Causes Allah's forgiveness and blessings.


·         Protection from the wrath of Allah and from a bad death.


·         A shelter on the Day of Judgment.


·         Security from seventy misfortunes.


 


Alqamah Radhiallaho anho says that when our group of people visited Rasulullah Sallallaho alaihe wasallam he said to them, "Verily you can make your Islam perfect by your payment of the Zakaat due on your property".


 


Rasulullah Sallallaho alaihe wasallam said, "he who observes three things will taste the sweetness of Imaan (faith): One who worships Allah alone and believes (from his heart) that there is no one to be worshipped but Allah and one who pays the Zakaat on his property, willingly, every year. In Zakaat on the animals, one should not give an aged animal or one suffering from itch or any other ailment, or an inferior one, but should give animals of average quality. Allah Ta'ala does not demand from you the best of your animals, nor does He command you to give animals of the worst quality".


 


Do I have to give Zakah?


Zakah is obligatory on an adult sane Muslim who has wealth that reaches or exceeds a certain level called the Nisab for a lunar year.(please contact your local Islamic Scholar about the exact amount of Nisab in your local currency). Unlike tax, however, Zakah is an act of worship for which one receives reward from Allah Ta’ala. Ignoring to pay Zakah, on the other hand, is a major sin.


How much do I have to give?


If you are in possession of money, gold, silver, stock in trade or shares that amount to more than the value of Nisab (at current market rates) then you are obliged to pay Zakah. What amounts are owed by you should be deducted from the capital amount before Zakah is calculated.


The rate of Zakah is 2.5%

Q: Me and my wife both are working and our assets are common e.g. we purchased property/Gold from common funds and we do not remember who paid more or less but we both are eligible to pay zakaat. So my question is in the above situation shall we calculate zakaat together or not. In the past we paid the zakaat together even though we didn't know if it is correct or not. Please guide accordingly.



A: If you'll agree that the gold, silver and zakaatable assets are owned jointly between yourselves e.g. each one owns 50%, then when discharging the zakaat, each one of you should discharge the zakaat of his portion. However, if one spouse discharges his zakaat as well as the zakaat of the other spouse, it will be permissible provided it is done with their consent.

And Allah Ta'ala (الله تعالى) knows best.

( ولم يزك أحدهما مال الآخر بغير إذنه فإن أذن كل وأديا معا ) أو جهل ( ضمن كل نصيب صاحبه ) وتقاصا أو رجع بالزيادة ( وإن أديا فتعاقبا كان الضمان على الثاني علم بأداء صاحبه أو لا كالمأمور بأداء الزكاة )

قال الشامي : قوله ( ولم يزك أحدهما الخ ) لأن الإذن بينهما في التجارة والزكاة ليست منها ولأن أداء الزكاة من شرطه النية وعند عدم الإذن لا نية له فلا تسقط عنه لعدمها ط عن الحموي قوله ( وأديا معا ) أي أدى كل منهما عن نفسه وعن شريكه ح وصورته كما قال ابن كمال بأن أدى كل منهما بغيبة صاحبه واتفق أداؤهما في وقت واحد (رد المحتار 4/ 328)

Q: Will the zakaat be fulfilled if it is given under the pretext of a gift or a loan?

 

A: If the person discharging the zakaat has the intention of zakaat at the time he gifted the wealth or loaned it to the poor person, the zakaat will be discharged. However, in the case where he gave the zakaat as a loan it is impermissible for him to take back the wealth. If he takes it back he will be sinful.

قوله ( نية ) أشار إلى أنه لا اعتبار للتسمية فلو سماها هبة أو قرضا تجزيه في الأصح ( شامى 2/268)

Q: A person gave zakaat to a muslim whom he regarded to be eligible for zakaat. However, after giving him the zakaat he discovered that he was unworthy of zakaat. Is the zakaat discharged?

 

A: If a person discharged the zakaat to a muslim whom he regarded to be eligible for zakaat then the zakaat will be discharged.

( دفع بتحر ) لمن يظنه مصرفا ( فبان أنه عبده أو مكاتبه أو حربي ولو مستأمنا أعادها ) لما مر ( وإن بان غناه أو كونه ذميا أو أنه أبوه أو ابنه أو امرأته أو هاشمي لا ) يعيد لأنه أتى بما في وسعه حتى لو دفع بلا تحر لم يجز إن أخطأ (شامى 2/352)

Assisting one's father with Zakaat
 
Q. My father is battling and I know for a fact that he is always short every month as he is a pensioner and does not have any other source of income. Can I give him my Zakaat?

Answer
A child cannot give his/her parents Zakaat and vice versa. You cannot assist your father with Zakaat funds. You can assist him with funds with the intention of optional Sadaqah if you wish or other family members (eg, his brothers, nephews etc) can assist him with Zakaat. A wife may not giver her Zakaat to her husband and vice versa.

Purchasing Hampers using Zakat Funds

 

Q: Is it permissible to use zakaat funds to purchase hampers and feed poor people? Similarly, is it permissible to provide Iftaar for the poor in the month of Ramadhaan using Zakaat funds?

 

A: It will be permissible to use Zakaat funds to feed poor people provided the requirement of tamleek is found. Tamleek means to transfer ownership of the wealth to someone who is eligible for zakaat. Therefore if the poor people were given the Zakaat hampers, the Zakaat will be discharged. And if the poor were not given the Zakaat hampers but were merely invited for a meal and were allowed to partake of it, then zakaat will not be discharged since the requirement of tamleek was not found. Similar is the case regarding the Iftaar food in the month of Ramadhaan, if the poor were given an Iftaar hamper the Zakaat will be discharged. And if the poor were not given the Zakaat hampers but were merely invited to partake of the food provided, then zakaat will not be discharged since the requirement of tamleek was not found.

قوله ( تمليكا ) فلا يكفي فيها الإطعام إلا بطريق التمليك ولو أطعمه عنده ناويا الزكاة لا تكفي (شامي 2/344)

Q. I have a diamond necklace which my husband gave me as a gift. Do I have to pay Zakaat on it ?

A. No. There is no Zakaat on precious stones or metals besides gold and silver unless they have been purchased with the intention of resale. If your diamond necklace if for personal use, there is no Zakaat on the diamond itself. However, if the necklace is of gold or silver, Zakaat will have to be paid on the gold or silver content only.

Q. Is it permissible to give Zakaat to build a well or borehole?

A.  One of the conditions for Zakaat to be discharged is that ownership must be given to the poor recipient or his/her proxy (if he/she has appointed one to accept funds on his/her behalf). A well or borehole in a community does not have any specific owner. Hence, ownership of the poor recipient is not established. Therefore, it is not permissible to use Zakaat to build wells or boreholes. The Zakaat will not be discharged if channeled in such avenues.

Calculating one's Zakaat after deducting liabilities - 

 

 

Q: Zaid contacts his travel agent on the 1st of Shabaan and obtains a quote to travel for umrah on the 1oth of Ramadaan. He immediately confirms and accepts this quotation of 100 000 but subject to him obtaining an Umrah visa. He may also cancel the booking at any time before 2nd of Ramadaan without any cost. His Zakaat year end is 15 Shabaan. May he deduct this 100 000 as a zakaat liability when calculating his Zakaat?

 

A: If he obtains the visa before the 15th of Shabaan then he will not include the R100 000 in his zakaatable assets and pay zakaat on it. On the contrary, if he obtains the visa after the 15th or he does not obtain the visa at all, then in both cases he should include the R100 000 in his zakaatable assets and pay zakaat on it. 

And Allah Ta'ala (الله تعالى) knows best.

( وحولها ) أي الزكاة ( قمري ) بحر عن القنية ( لا شمسي ). (الدر المختار 2/294)

( وسببه ) أي سبب افتراضها ( ملك نصاب حولي ) نسبه للحول لحولانه عليه ( تام ) . ( الدر المختار 2/259)

وشرطه أي شرط افتراض أدائها ( حولان الحول ) وهو في ملكه ( وثمنية المال كالدراهم والدنانير ) . ( الدر المختار 2/267)

Upon which Wealth does a Person have to Pay Zakaat?

 

Q: Upon which wealth does a person have to pay zakaat?

A: Zakaat will be paid on the following:

  1. Cash (including the balance of your bank deposits).
  2. The market value of the merchandise contained in the share of the company i.e. one will be obligated to discharge the Zakaat of the company’s Zakaatable assets (merchandise) contained in the share excluding the non-Zakaatable items e.g. fixtures and fittings, transport vehicles, etc. which are not part of the merchandise of the company. The value of all these things will be evaluated in the share and will not be taken in account when discharging the zakaat. If it is difficult to differentiate between the zakaatable and non-Zakaatable assets of the company, then as a precautionary measure one should discharge the Zakaat on the market value of the entire share.
  3. Face value of the financial papers like bonds loaned to the government, etc. It should be noted that when the loan is paid back by the government, it will only be permissible for one to retrieve the original amount of the loan given. The interest amount paid out by the government will be impermissible. It will have to be given in sadaqah without the intention of receiving reward. Similarly, it should be known that it is impermissible for a believer to deal in any form of interest (usury) whether it be receiving or giving an interest bearing loan.
  4. The market rate of the balance of stock in trade (including raw material).
  5. Receivable amounts i.e. debts owed to a person, monies loaned to people, etc.
  6. Foreign currencies.
  7. Gold and silver.

(لا زكاة في اللآلىء والجواهر ) وإن ساوت ألفا اتفاقا ( إلا أن يكون للتجارة ) والأصل أن ما عدا الحجرين والسوائم إنما يزكى بنية التجارة (ج2 ص 273)

أو المستفاد ولو بهبة أو إرث وسط الحول يضم إلى نصاب من جنسه فيزكيه بحول الأصل (شامي 2/288)

نصاب الذهب عشرون مثقالا والفضة مئتا درهم ، كل عشرة دراهم وزن سبعة مثاقيل … إلخ (شامي 2/295)

(و) اعلم أن الديون عند الإمام ثلاثة قوي ومتوسط وضعيف (فتجب) زكاتها إذا تم نصابا وحال الحول لكن لا فورا بل (عند قبض أربعين درهما من الدين) القوي كقرض (وبدل مال تجارة) فكلما قبض أربعين درهما يلزمه درهم (و) عند قبض (مائتين منه لغيرها) أي من بدل مال لغير تجارة وهو المتوسط كثمن سائمة وعبيد خدمة ونحوهما مما هو مشغول بحوائجه الأصلية كطعام وشراب وأملاك ويعتبر ما مضى من الحول قبل القبض في الأصح ومثله ما لو ورث دينا على رجل (و) عند قبض (مائتين مع حولان الحول بعده) أي بعد القبض (من) دين ضعيف وهو (بدل غير مال) كمهر ودية وبدل كتابة وخلع

قوله (في الأصح) قد علمت أنه ظاهر الرواية وعبارة الفتح و البحر في صحيح الرواية قلت لكن قال في البدائع إن رواية ابن سماعة أنه لا زكاة فيه حتى يقبض المائتين ويحول الحول من وقت القبض هي الأصح من الروايتين عن أبي حنيفة اهـ ومثله في غاية البيان وعليه فحكمه حكم الدين الضعيف الآتي (شامي 2/305)

Zakaat on Platinum, Gems, Rubies, Diamonds, Sapphires, etc?

Q: Is zakaat compulsory upon platinum, gems, rubies, diamonds, sapphires, etc?

A: Zakaat is not compulsory on all precious stones besides gold and silver unless they were purchased with the intention of resale.

(لا زكاة في اللآلىء والجواهر ) وإن ساوت ألفا اتفاقا ( إلا أن يكون التجارة ) والأصل أن ما عدا الحجرين والسوائم إنما يزكى بنية التجارة (ج2 ص 273)

Wealth Received before one's Zakaat Date

 

Q: What is the mas’alah regarding a person who received some wealth prior to the completion of the zakaatable year?

E.g. Zaid’s zakaatable year ends on the 1st of Ramadhaan. Few days before the 1st of Ramadhaan, he received a lump sum of R1, 000, 000 in inheritance. Will Zaid have to pay zakaat on the R1, 000, 000 as well?

A: Zaid will have to pay zakaat on the R1, 000, 000 as well.

Wealth Received before one's Zakaat Date

 

Q: What is the mas’alah regarding a person who received some wealth prior to the completion of the zakaatable year?

E.g. Zaid’s zakaatable year ends on the 1st of Ramadhaan. Few days before the 1st of Ramadhaan, he received a lump sum of R1, 000, 000 in inheritance. Will Zaid have to pay zakaat on the R1, 000, 000 as well?

I  am  confused  .  We  are  supposed  to give  Zaakat  after   one  year  .

what this Q/A is explaining is that if wealth gets added to the initial amount then the zakat will be calculated on the whole amount and not just the amount which the person had initially...many people don't realise this which means they haven't paid zakat in full

Wealth Decreased before the Zakaat Date

 

Q: What is the mas’alah regarding a person whose wealth decreased before the zakaat date?

E.g. Bakr possessed R1, 000, 000 throughout the year. Just before the end of his zakaatable year i.e. 1st of Ramadhaan, he suffered a loss of R900, 000 in his business. Will Bakr now have to pay zakaat on R1, 000,000 or R100, 000?

Q: My question is about zakat for shops, like book stores, general stores, medical stores etc.

 

First question is, Zakat is payable on inventory in the shop or income of the shop??

 

Secondly, if it is on inventory or "goods for sale"  which goes up n down every month plus it is not possible to calculate the exact value of items then how to give zakat?

 

I am follower of fiqh Hanafi, so please guide me from that school of thoughts with reference.
