Is It Necessary That The Niqaab Of A Woman Does Not Touch Her Face While In Ihraam?

 

Question

While performing Hajj is it necessary that the Niqaab of a woman does not touch her face while she is in Ihraam?Can she give some charity if she finds this difficult?

 

Answer

 

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

Leaving the face uncovered is part of the woman’s Ihrām.  Nabi Sallallāhu Alaihi Wa Sallam has said:

 

“The Ihrām of a female is in her face and the Ihrām of a man is in his head.”

(Sunan Ad-Dāru Qutni, Hadīth No. 2761)[1]

 

In these times of corruption and evil, it is advisable that a woman in Ihrām covers her face in such a way that the covering cloth (niqāb) does not touch the face. That is by wearing a cap and drawing the niqāb from a distance away from the face.  However if we suppose the niqāb does end up touching the face, then charity equivalent to the amount of Sadaqatul Fitr is due.  And if she wears niqāb whilst touching her face for a complete day, a Damm (sacrificed animal) is due.[2]  [3]

Wearing the cap niqab during ihram

 

Question:

Assalamu Alaykum

what is the ruling on wearing the cap niqab during ihram when going for umrah?

if someone didnt want to wear it or is not comfortable in it is it permissible for them to wear their normal niqab and then pay some money?

 

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 

1. It is commendable to wear the Niqab cap and cover the face without the veil touching the face.[1]

 

2. It is impermissible for a woman to cover the face duringIhraam.[2] If a woman covered her face with a Niqaab for one complete day or more, that will be considered as a Jinaayah(crime) for which one Damm (sacrilegious penalty) will become compulsory.

 

If a woman had covered her face with a Niqaab for lesser than a day, she should expend some charity (Sadaqah).[3]

<QUESTION>

Is it necessary for a woman to cover her face during Ihram (during Umrah/Hajj)? Will she be excused for not covering her face due to the difficulties associated with niqabs hanging from baseball caps? Inshallah as soon as my state of Ihram is complete, I would wear the Niqab but what about during the days of ihram?

 
<ANSWER>
In the name of Allah, Most Compassionate, Most Merciful,

The ruling in the Hanafi Madhhab (and even in other madhhabs) is that, although the face is not considered to be part of one’s nakedness (awra), it is necessary to cover it, due to the fitna involved in not doing so. This is the transmitted position in the Hanafi School, as mentioned in virtually all the major fiqh books.

 

Some contemporary scholars have a more lenient approach to this issue, especially for the West. However, my understanding is (according to what I have learnt from my teachers) that a woman is required to cover her face even in the west except in dire situations.

 

As such, if you are travelling for Hajj, and you normally cover your face at home, you must cover it whilst in the state of Ihram also. This covering must be done in a way that the Niqab does not touch the face, such as wearing a cap, etc…

 

Indeed a woman must not have a cloth whilst in Ihram that touches her face. However, at the same time, she should avoid exposing her face in front of non-Mahram men, especially when she is young and when the risk of Fitna is greater.

 

As such, in the presence of non-Mahram men, she should cover her face in a way that no clothing touches her face, by wearing a cap or something else. Even in the days of the Messenger of Allah (Allah bless him & give him peace), the female Companions (Allah be pleased with them) abstained from exposing their faces in front of non-Mahram men.

 

Sayyida A’isha (Allah be pleased with her) narrates that, the (caravan of) riders would pass by us whilst we were in the state of Ihram in the company of the Messenger of Allah (Allah bless him & give him peace). When they got close to us, we would draw our outer cloak from our heads over our faces (m, without letting it touch the face) and when they passed by, we would uncover our faces.” (Sunan Abu Dawud, no. 1826)

 

However, if it becomes very difficult, in that it becomes virtually impossible to wear the niqab (even with a cap, etc), and you fear harm onto yourself, then in such a case you will be excused in leaving the face exposed, but try to keep the face away from non-Mahram men whenever reasonably possible.

Discharging the damm for covering the face in Ihraam

 

Q: If a woman in the state of Ihraam covers her face, will damm become waajib on her?

A: In the state of Ihraam if quarter or more of the face is covered for an entire day or night (i.e. 12 hours) or more then, one damm becomes waajib. If quarter or more of the face is covered for less than one day or night then sadaqa becomes waajib. If less than quarter of the face is covered for an entire day or night or more, then sadaqa becomes waajib.

( يتقي الرفث ) …. ( وقلم الظفر وستر الوجه ) كله أو بعضه كفمه وذقنه نعم في الخانية لا بأس بوضع يده على أنفه… قال الشامى: قوله ( كله أو بعضه ) لكن في تغطية كل الوجه أو الرأس يوما أو ليلة دم الربع منهما كالكل وفي الأقل من يوم أو من الربع صدقة كما في اللباب وأطلقه فشمل المرأة لما في البحر عن غاية البيان من أنها لا تغطي وجهها إجماعا اه أي وإنما تستر وجهها عن الأجانب بإسدال شيء متجاف لا يمس الوجه كما سيأتي آخر هذا الباب وأما في شرح الهداية لابن الكمال من أنها لها ستره بملحفة وخمار وإنما المنهي عنه ستره بشيء فصل على قدره كالنقاب والبرقع فهو بحث عجيب أو نقل غريب مخالف لما سمعته من الإجماع ولما في البحر وغيره في آخر هذا الباب (شامى ج 2 ص 488)

و حيثما أطلق الصدقة في جناية الإحرام فهي نصف صاع من بر أو صاع من غيره إلا في جزاء اللبس و الطيب و الحلق و قلم الأظفار إذا فعل شيئا منها كاملا بعذر فهي ثلاثة أصوع طعام أو ستة من غيره و الا في جزاء اللبس اقل من ساعة و جزاء الثلاث و ما دونها من الشعر و الجراد و القمل ففيها تصدق بما شاء و لو يسيرا و الا في قتل المحرم صيدا فهي فيه قدر القيمة (لباب و غيره)… و كل صدقة تجب في الطواف فهي لكل شوط نصف صاع أو في الرمي فلكل حصاة صدقة…(لباب) –(غنية الناسك ص240)
